Terms and Conditions of Service

The Company's Terms and Conditions of Service shall constitute acceptance of all terms and conditions set forth in this document. The user acknowledges that they have read and understood all terms and agrees to be bound by this agreement in all respects.

Terms and Conditions

1. General Provisions

1.1 This agreement is made between ServerToday (Thailand) Co., Ltd. (hereinafter referred to as the "Company") and the applicant for service (hereinafter referred to as the "User").

1.2 This agreement shall become effective immediately upon the user's acceptance of the terms of service and/or upon commencement of the Company's services.

1.3 The Company reserves the right to amend, modify, or improve this agreement at any time as it deems appropriate, with prior notice to the user through appropriate channels.

2. Personal Data Protection

2.1 The Company places importance on the protection of users' personal data in compliance with:

  • Personal Data Protection Act B.E. 2562 (2019) (PDPA)
  • General Data Protection Regulation (GDPR)
  • California Consumer Privacy Act (CCPA)

2.2 Use of user data:

  • The Company will use data solely for the purpose of providing services to the user.
  • The Company will not use data for advertising or any other commercial purposes.
  • The user remains the owner of all rights and ownership in the data.

2.3 Disclosure of data:

  • The Company will not disclose data to third parties, except where:
  • the user has given consent
  • it is in compliance with a court order or a lawful order from a competent government authority
  • disclosure is required by law

3. Security

3.1 Password security:

  • The user is responsible for maintaining the security of passwords and all account access information.
  • Passwords must be created in accordance with international security standards:
  • at least 8 characters in length
  • contain uppercase letters, lowercase letters, numbers, and special characters
  • must not be easily guessable
  • must be changed periodically as appropriate, especially when a security risk is identified
  • must be stored securely and kept confidential; passwords must not be disclosed to any other person under any circumstances
  • must not be reused across other accounts within the organization and should not be shared with other services

3.2 Reporting security breaches:

  • The user must immediately notify the Company if unauthorized account use is found or suspected, or if any security breach is discovered.
  • The user must cooperate in the investigation of security breaches.

3.3 Additional security measures:

  • The Company recommends enabling Two-Factor Authentication (2FA) to enhance account security.
  • If the current service does not support 2FA, an upgrade to a service package that supports such features should be considered.
  • Once the user has enabled additional security measures, the user is obligated to strictly comply with the identity verification procedures prescribed by the Company.

4. Restrictions on Use of Service

4.1 The service must not be used for:

  • engaging in illegal activities
  • distributing malware, viruses, or harmful programs
  • attacking other systems or networks
  • infringing copyright or intellectual property rights
  • distributing obscene materials
  • sending spam emails
  • engaging in conduct contrary to public order or good morals

4.2 Use of system resources:

  • System resources must be used appropriately and not beyond the specified limits.
  • The service must not be used in a manner that may affect the performance of the overall system.

5. Suspension and Termination of Service

5.1 The Company has the right to suspend or terminate the service immediately in the following cases:

  • the user breaches the agreement
  • payment for service is not made when due
  • the service is used for unlawful purposes
  • there is a security necessity

5.2 Termination of service by the user:

  • at least 30 days' prior notice must be given
  • all outstanding service fees must be fully paid
  • data must be backed up and equipment removed within the specified period

6. Limitation of Liability

6.1 General limitation of liability

  • The Company reserves the right to disclaim all liability for damages in the following cases:

6.1.1 Damages related to access and security

  • Access to user accounts using valid authentication credentials, whether such access is by the user or by a third party.
  • Damages arising from leakage, theft, or unauthorized use of passwords resulting from the user's failure to comply with security measures.

6.1.2 Damages related to data

  • Loss of or damage to data for which the user has not created backup copies in accordance with the Company's recommended practices.
  • Damages resulting from failure to comply with the security measures specified in Clause 3.1.

6.1.3 Indirect and special damages

  • Indirect or consequential damages, including but not limited to:
  • loss of revenue or business profits
  • loss of business opportunities
  • damage to reputation
  • punitive damages or any other special damages

6.1.4 Service interruption

  • Service interruption caused by force majeure events, including but not limited to:
  • natural disasters
  • terrorism
  • telecommunications system failures
  • widespread internet disconnection
  • other events beyond the Company's reasonable control

6.2 Maximum liability of the Company:

  • This limitation of liability shall apply to the fullest extent permitted by law and shall in no event exceed the service fees received from the user in the current billing cycle.

7. Contact and Problem Reporting

7.1 Contact channels:

  • Contact must be made only via Email or Ticket Support.
  • Contact must be made from the registered user account.
  • The Company does not accept reports through other channels such as LINE or LINE@.

7.2 Problem reporting:

  • The issue details must be clearly specified.
  • Necessary information for resolving the issue must be provided.
  • Responses to requests for additional information must be made within an appropriate period.

8. Service Updates

8.1 The Company has the right to:

  • improve or modify the service to enhance efficiency
  • temporarily suspend the service for system maintenance
  • add or discontinue certain features as appropriate

8.2 Notice of changes:

  • The Company will provide reasonable prior notice of material changes.
  • The user is responsible for monitoring announcements of changes from the Company.

9. Miscellaneous

9.1 Changes to information:

  • The user must immediately notify the Company of any changes to contact information.
  • Account information must be kept up to date.

9.2 Governing law:

  • This agreement shall be governed by Thai law.
  • Any disputes shall be subject to the jurisdiction of Thai courts.

10. Acceptance of the Agreement

Use of the Company's services constitutes acceptance of all terms and conditions stated in this document. The user acknowledges that they have read and understood all terms and agrees to be bound by this agreement in all respects.

10.1 Implied acceptance:

  • Commencement of service use shall constitute implied acceptance of the agreement.
  • Payment for the service shall constitute implied acceptance of the agreement.
  • Failure to object within 15 days after notice of amendment to the agreement shall constitute acceptance of the revised agreement.

10.2 Effect of acceptance:

  • The user agrees to be bound by all provisions of the agreement.
  • The user acknowledges that they have read and fully understood the agreement.
  • The user accepts the risks that may arise from the use of the service.

Effective Announcement

This Terms and Conditions of Service document shall be effective from January 1, 2024 onwards.
